- Have read and agreed to the Process and have read the ITP and all associated documents.
- All information provided in its submission is complete, accurate and is not misleading in any way.
- The submission does not contain intellectual property that will breach a third party's rights.
- There are no undisclosed conflicts of interest and agree to notify Kāinga Ora – Urban Development Delivery as soon as possible of conflicts of interest that arise (or could arise) in the future.
- Other than what is has disclosed to Kāinga Ora – Urban Development Delivery, the Respondent is not involved in any current or pending litigation, arbitration or administrative proceedings which may adversely affect the business or reputation of Kāinga Ora – Urban Development Delivery if the Respondent becomes a Partner.
- The Respondent is financially solvent and operates as a going concern.
- The Respondent and its project teams are eligible to work in New Zealand.
- The Respondent does not have any Restraints of Trade against it which may inhibit working with Kāinga Ora – Urban Development Delivery in the proposed areas.
- The Respondent has not engaged, and will not engage, in uncompetitive behaviour which may deny legitimate business opportunities to other Respondents.
- Have correctly disclosed whether the Respondent is subject to the Overseas Investment Act 2016.
- Agree the Terms of Contract in the Heads of Agreement accompanying the ITP will be the terms used if a contract is awarded to a Partner. Kāinga Ora – Urban Development Delivery.
I/We understand that the falsification of information, supplying misleading information or the suppression material information in this declaration and the submission may result in the submission being eliminated from further participation in the Panel process and may be grounds for termination of any contract awarded as a result of the Panel process.
